USE AGREEMENT
USE AGREEMENT, entered into between the clients' parents (Property Owners) and (Occupant(s).
For good consideration it is agreed between the parties as follows:
1.The Parents hereby Agrees and lets to
Occupy the premises described as follows:
Approx 1200sq ft. 3-bedroom 2 bath house.
Fenced back yard and covered patio.
2. This Use Agreement shall be for an indefinite term
commencing on hire date and ends when employment ends. 
3. Occupant(s) shall be entitled to occupy said space
during the time in which occupant(s) is providing full
time care for client.
4. Occupant(s) shall pay a security deposit of $500.00, to be returned upon termination of this Use Agreement and/or performance of all other obligations and after inspection of premises. Occupant shall return possession of the premises in its present condition, reasonable wear and tear, fire casualty excepted. Security deposit may be worked out with clients' parents over time on an individual case by case basis.
Occupant(s) shall commit no waste to the premises.

and keep exterior free and clear of trash, and clutter.
5. Occupant(s) shall at its own expense provide the
following utilities or services:
 

  • Electricity 

  • Water

  • Cable

  • Telephone 

  • Internet 

  • Security

  • Lawn Care (required to be kept regularly) 

  • Pest Control

 
6. Occupant(s) further agrees that they shall:
(i) maintain the property in its current condition and
report any needed repairs either real or potential to
the property owner as soon as discovered.
(ii) Replace the a/c filter monthly, filters will be
provided by client's parents.
(iii) Keep the exterior of the property neat and clean 
all times.
(iv) Not operate a business out of the property.
7. Occupant(s) shall not assign or sublet said premises or allow any other person to occupy the premises without the client's parent’s prior written consent.
Additional persons occupying premises will be subject to background check before permitted to occupy property. Any additional occupant(s) are subject to the same terms of this agreement and would be required to sign an understanding form.
8. Occupant(s) shall not make any material or structural alterations to the premises without prior written consent from the client's parents.
9. Occupant(s) shall comply with all building, zoning and health codes and other applicable laws for the use of said premises.
10. Occupant(s) shall not conduct on premises any activity deemed extra hazardous, or a nuisance, or requiring an increase in fire insurance premiums.
11. Occupant(s) shall not allow pets on the premises.
Other than what was discussed prior to occupying
living space. Should occupant(s) acquire a dog or cat
after occupying premises, Occupant(s) would keep the animal secured in yard and not run loose.

No aggressive breeds will be permitted. It is further understood that should occupant acquire a dog and/or cat, that occupant(s) would be required to place an additional deposit in the amount of $100.00 for a cat and/or$150.00 for a dog.
Occupant(s) also agrees to full liability of any and all damage caused to space, and area used by occupant(s) inside and out and that the animal would be kept current of all required shots and tags. Upon vacating residence.

12. In the event of any breach of this Use Agreement,
the client's parents shall have full rights to
terminate this Use Agreement in accordance with the
law and re-enter and re-claim possession of the
premises, in addition to such other remedies available to the client's parents arising from said breach.
13. It is understood by occupant that this Use Agreement is not to be deemed as a lease or rental agreement and occupant waves his/her right to due process and standard practices under this agreement. Occupant further acknowledges that the use of said premises is not compensation for services but gratuity for the security's sake of client and to ensure immediate access to client’s care.
This Use Agreement shall be binding upon and inure to the benefit of the parties, their successors, assigns and personal representatives.

14. Should your employment for care of the client be terminated by you or the client, you agree to vacate the property within 30 days. during that time a use fee would be imposed at a prorated charge based of $75.00 per day.
